1. Purpose
This Donor Rights Policy establishes the rights and protections afforded to all individuals who provide a specimen through Battle Tested Specimen Collections. We are committed to treating every donor with dignity, respect, and professionalism regardless of the reason for testing, the collection outcome, or any other factor. This policy applies to all DOT and Non-DOT collections performed by Battle Tested Specimen Collections.
2. Who is a Donor?
A donor is any individual who provides or is asked to provide a biological specimen for drug screening purposes through Battle Tested Specimen Collections. This includes:
— Employees directed by their employer to undergo drug testing
— Job applicants undergoing pre-employment drug screening
— Individuals undergoing court-ordered or legally mandated drug testing
— Self-pay individuals requesting drug testing on their own behalf
— CDL holders and other DOT-regulated workers undergoing federally mandated testing
3. Core Donor Rights
Every donor has the following rights when using the services of Battle Tested Specimen Collections:
3.1 Right to Dignity and Respect
Every donor has the right to be treated with dignity, courtesy, and respect throughout the entire collection process. Battle Tested Specimen Collections does not tolerate disrespectful, demeaning, or discriminatory treatment of any donor by the Collector or any representative of the company. Donors will not be judged, accused, or treated differently based on the reason for their test or any personal characteristic.
3.2 Right to Privacy
Every donor has the right to privacy during the specimen collection process. Urine collections are conducted in a private restroom with the door closed. The Collector does not observe the donor during a standard urine collection unless an observed collection is specifically required under DOT regulations or employer protocol. When an observed collection is required the donor will be informed of the reason before the observation begins.
3.3 Right to Be Informed
Every donor has the right to be informed about the collection process before it begins including:
— What type of specimen is being collected
— How the collection will be conducted
— What the chain of custody process involves
— What will happen with the specimen after collection
— What laboratory partner will process the specimen
— What the MRO review process involves for non-negative results
— What a non-negative rapid screen result means and what happens next
3.4 Right to Identification Verification
Every donor has the right to verify the identity of the Collector. Upon request Battle Tested Specimen Collections will provide the Collector's name and DOT Collector certification credentials. Donors may confirm that the Collector is certified and authorized to perform their collection.
3.5 Right to a Copy of the CCF
Every donor has the right to receive a copy of the completed chain of custody form (Copy 5 of the Federal CCF for DOT collections or the equivalent Non-DOT form) at the time of collection. Donors should retain this copy for their records.
3.6 Right to Speak with the MRO
Every donor whose specimen returns a non-negative or confirmed positive result has the right to speak with the Medical Review Officer (MRO) before a final result is reported to the employer. The MRO will contact the donor directly to discuss any prescription medications, medical conditions, or other legitimate explanations that may affect the result. Donors have the right to present this information to the MRO without fear of retaliation.
3.7 Right to Request a Split Specimen Test
For DOT collections where a split specimen was collected a donor who receives a confirmed positive result has the right to request that the split specimen (Bottle B) be tested at a second SAMHSA-certified laboratory. This request must be made through the MRO within 72 hours of being notified of the confirmed positive result. Battle Tested Specimen Collections will ensure that split specimens are properly collected and sealed to preserve this right.
3.8 Right to Confidentiality
Every donor has the right to confidentiality of their test results and personal information. Battle Tested Specimen Collections will not disclose a donor's results, personal information, or collection details to any unauthorized party. Authorized parties include the donor, the employer of record, the laboratory, the MRO, and regulatory authorities with proper authorization. 3.9 Right to Refuse to Test
Every donor has the right to refuse to provide a specimen or participate in the collection process. The Collector will never physically force, coerce, or threaten a donor to provide a specimen. Donors are informed that under DOT regulations a refusal to test carries the same regulatory consequences as a verified positive result. Non-DOT consequences are determined by the employer's drug-free workplace policy.
3.10 Right to Report Concerns
Every donor has the right to report concerns about the collection process, Collector conduct, or any aspect of their testing experience without fear of retaliation. Concerns may be reported to Battle Tested Specimen Collections directly, to the employer's designated employer representative, to the MRO, or to the applicable regulatory authority.
4. Donor Protections — Non-Discrimination
Battle Tested Specimen Collections does not discriminate against any donor on the basis of:
— Race, color, or ethnicity
— National origin or immigration status
— Sex or gender identity
— Age
— Disability or medical condition
— Religion
— Sexual orientation
— Veteran or military status
— Any other characteristic protected by applicable federal or Washington State law
All donors receive the same professional, standardized collection process regardless of personal characteristics or the nature of their test.
5. Donor Protections — Washington State Specific Rights
Washington State donors have the following additional protections:
5.1 Cannabis Pre-Employment Protection
Under Washington State Senate Bill 5123 employers may not discriminate against job applicants based solely on a positive pre-employment cannabis (THC) test result for Non-DOT positions. This protection does not apply to DOT-mandated testing programs, safety-sensitive positions specifically exempted under SB 5123, or positions in the cannabis industry.
5.2 Health Data Privacy
Washington State donors have rights under the Washington My Health MY Data Act (MHMD) regarding the collection, use, and sharing of health-related data. Battle Tested Specimen Collections complies with all applicable MHMD requirements.
5.3 Equal Access
Washington State donors with disabilities have the right to accessible collection services. Battle Tested Specimen Collections provides mobile collections that accommodate a wide range of physical accessibility needs. 6. Donor Responsibilities
In addition to their rights donors have the following responsibilities during the collection process:
— Present a valid government-issued photo ID at the time of collection
— Follow Collector instructions throughout the collection process
— Provide an accurate and honest specimen
— Not attempt to adulterate, substitute, or tamper with the specimen
— Not bring unauthorized items into the collection area
— Treat the Collector with respect and courtesy
— Sign the chain of custody form as directed
— Disclose relevant prescription medications or medical conditions to the MRO during the review process
7. Observed Collections — Donor Rights
When an observed collection is required the donor has the following specific rights:
— The right to be informed that the collection will be observed and the specific reason for the observation before it begins
— The right to be observed by a Collector of the same gender
— The right to have the observation conducted in the least intrusive manner consistent with regulatory requirements
— The right to ask questions about the observed collection process before it begins
— The right to refuse the observed collection — with the understanding that refusal is treated as a refusal to test under applicable regulations
8. Donor Concerns & Complaints
If a donor has a concern or complaint about their collection experience Battle Tested Specimen Collections takes all concerns seriously and is committed to addressing them promptly and professionally.

— Any witnesses or documentation you believe are relevant
Step 3 — We will acknowledge your concern within 2 business days and provide a response within 5 business days.
Additional Reporting Options:
Donors may also report concerns to:
— The employer's Designated Employer Representative (DER)
— The Medical Review Officer (MRO)
— The U.S. Department of Transportation at dot.gov for DOT-regulated collections
— The Washington State Human Rights Commission at hum.wa.gov for discrimination concerns
9. Collector Code of Conduct
Every collection performed by Battle Tested Specimen Collections is conducted in accordance with the following Collector Code of Conduct:
— Treat every donor with dignity, professionalism, and respect
— Maintain donor confidentiality at all times
— Follow all applicable DOT and Non-DOT collection protocols without exception
— Never make accusations or prejudge any donor
— Never accept inducements to compromise the integrity of a collection
— Maintain current DOT Collector certification and complete all required continuing education
— Report any attempt by any party to compromise the collection process to the appropriate authorities
— Conduct every collection with the same high standard of professionalism regardless of the donor's background or the nature of the test
10. Record Retention
Donor rights-related records including concern reports and their resolutions are retained for a minimum of 2 years. Records are stored securely and accessed only by authorized personnel.
