1. Acceptance of Terms

 

These Terms and Conditions ("Terms") govern your use of the website located at www.battletestedwa.com and all services provided by Battle Tested Specimen Collections, a DBA of Battle Tested LLC ("Company," "we," "us," or "our"). By accessing our website, booking a service, submitting an inquiry, or engaging our mobile collection services you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms please do not use our website or services. These Terms apply to all visitors, clients, donors, employers, and any other party who interacts with our website or services.

 

 

2. Services

 

Battle Tested Specimen Collections provides mobile DOT and Non-DOT drug screen collection and specimen collection services in King County and South King County, Washington. Our services include but are not limited to:

— DOT Urine Drug Screen Collection
— Non-DOT Urine Drug Screen Collection
— Non-DOT Rapid Drug Screen (7 Panel and 13 Panel)
— Mobile on-site collection at employer and client locations

We reserve the right to modify, suspend, or discontinue any service at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of services.

 

 

3. Eligibility

 

By using our services you represent and warrant that:

— You are at least 18 years of age or are a legally authorized representative acting on behalf of a minor donor when required by law
— You have the legal authority to enter into these Terms on behalf of yourself or the organization you represent
— You will provide accurate, complete, and current information when booking services or submitting inquiries
— You will comply with all applicable federal, state, and local laws and regulations related to drug testing

 

 

4. Booking & Appointments

 

4.1 Scheduling
Appointments may be scheduled through our online booking system at www.battletestedwa.com or by contacting us directly at (206) 939-0335 or info@battletestedwa.com. All appointments are subject to availability and confirmation by Battle Tested Specimen Collections.

 

4.2 Confirmation
Your appointment is not confirmed until you receive a written confirmation from us. We reserve the right to decline or cancel any booking at our discretion.

 

4.3 Identification
All donors must present a valid government-issued photo ID at the time of collection. Collections cannot proceed without valid identification. Acceptable forms of ID include a driver's license, state ID, passport, or military ID.

 

4.4 Collection Location Requirements
For urine drug screen collections a private restroom must be available at the collection address. The collection location must meet DOT collection site standards for DOT-mandated collections. We reserve the right to decline a collection if the location does not meet required standards.

 

4.5 Cancellations & No-Shows
Cancellations made more than 24 hours before a scheduled appointment will receive a full refund. Cancellations made less than 24 hours before a scheduled appointment are subject to a $25.00 late cancellation fee. Cancellations made less than 2 hours before a scheduled appointment or no-shows are subject to a $50.00 fee. Travel fees are non-refundable once the Collector has departed for your location.

 

 

5. Payment

 

5.1 Individual Clients
Payment is authorized at the time of booking and captured upon completion of your collection. We accept all major credit and debit cards, Apple Pay, and Google Pay. Collections will not be confirmed without a valid authorized payment method.

 

5.2 Employer Accounts
Employer accounts are invoiced within 24 hours of collection completion. New employer accounts are billed on Net-15 terms. Established employer accounts with consistent payment history may qualify for Net-30 terms. A late payment fee of 1.5% per month will be applied to balances outstanding beyond the payment due date.

 

5.3 Laboratory Fees
Collection fees do not include laboratory processing fees. Lab fees are billed separately and are not included in your booking total. Lab fees will be communicated prior to your appointment.

 

5.4 Travel Fees
Zone-based travel fees apply to all mobile collections and are invoiced separately after each appointment:

Zone 1 (0–10 miles): No charge
Zone 2 (11–20 miles): $17.50
Zone 3 (21–30 miles): $35.00
Zone 4 (31–40 miles): $52.50
Zone 5 (41–50 miles): $70.00
Beyond 50 miles: By quote

 

5.5 Additional Fees
Additional fees may apply for shy bladder protocol ($75.00), observed collections ($20.00), after-hours or urgent collections ($30.00), and

Employer No-Show Fee ($50.00)  applies when the Collector arrives on-site and no employees are available for collection.

6. Collector Role & Limitations

 

Battle Tested Specimen Collections operates as a certified specimen collector only. We expressly:

— Do not process, analyze, or interpret drug test results
— Do not employ a Medical Review Officer (MRO)
— Do not have access to final laboratory results
— Do not make or influence employment decisions
— Do not provide legal, medical, or compliance advice
— Do not guarantee specific turnaround times for laboratory results as these are determined by our laboratory partners

 

Official drug test results are delivered directly by our laboratory partners DISA Global Solutions and MedTox through their respective employer portals. Battle Tested Specimen Collections is not responsible for result delivery, result accuracy, or MRO determinations.

 

 

7. Donor Rights & Responsibilities

 

7.1 Donor Rights
All donors have the right to:
— Be treated with dignity and respect throughout the collection process
— Receive a copy of the completed chain of custody form upon request
— Contact the MRO to discuss a non-negative result
— Refuse to test — however refusal is treated as a positive result under DOT regulations

 

7.2 Donor Responsibilities
All donors are required to:
— Present a valid government-issued photo ID
— Follow all collector instructions during the collection process
— Not attempt to adulterate, substitute, or tamper with a specimen
— Disclose any prescription medications or medical conditions that may affect the collection to the MRO during the review process

 

7.3 Specimen Tampering
Any attempt to adulterate, substitute, or tamper with a specimen is strictly prohibited and will be reported as a refusal to test in accordance with DOT regulations. We reserve the right to terminate a collection immediately upon reasonable suspicion of tampering.

 

 

8. Non-Negative Results

 

A non-negative result on a rapid drug screen is not a confirmed positive. Non-negative specimens will be sent to a certified laboratory for GC/MS confirmation testing. Confirmation results are reviewed by a certified MRO before being reported to the employer. Battle Tested Specimen Collections does not report, interpret, or act on non-negative or confirmed positive results. Laboratory confirmation fees apply for non-negative rapid screen results and are billed separately.

 

 

9. Washington State Compliance

 

9.1 Cannabis Testing
Washington State Senate Bill 5123 prohibits employers from discriminating against applicants in hiring decisions based solely on a positive pre-employment cannabis test result for Non-DOT positions. This restriction does not apply to DOT-mandated drug testing programs. Employers are solely responsible for ensuring compliance with SB 5123 and all applicable Washington State employment laws.

 

9.2 MTS License
Battle Tested Specimen Collections operates as a specimen collection service and does not perform laboratory analysis. No MTS laboratory license is required for the collection services we provide under Washington State law.

 

 

10. Intellectual Property

 

All content on our website including text, graphics, logos, images, and service descriptions is the property of Battle Tested Specimen Collections or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our express written consent.

 

 

11. Website Use

 

11.1 Permitted Use
You may use our website for lawful purposes only. You agree not to:
— Use our website in any way that violates applicable laws or regulations
— Attempt to gain unauthorized access to any part of our website or systems
— Transmit any harmful, offensive, or disruptive content through our website
— Use our website to collect information about other users without their consent
— Interfere with or disrupt the operation of our website

 

11.2 Third Party Links
Our website may contain links to third party websites including laboratory partner portals. These links are provided for your convenience only. We do not endorse or control the content of third party websites and are not responsible for their content, privacy practices, or availability.

 

 

12. Disclaimer of Warranties

 

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind either express or implied. We do not warrant that:

— Our website will be uninterrupted, error-free, or free of viruses or harmful components
— The information on our website is accurate, complete, or current
— Our services will meet your specific requirements or expectations

To the fullest extent permitted by law we disclaim all warranties express or implied including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

 

13. Limitation of Liability

 

To the fullest extent permitted by applicable law Battle Tested Specimen Collections shall not be liable for any indirect, incidental, special, consequential, or punitive damages including but not limited to loss of profits, loss of data, or loss of business opportunity arising out of or related to your use of our services or website.

Our total liability to you for any claim arising under these Terms shall not exceed the total amount paid by you for the specific service giving rise to the claim.

 

 

14. Indemnification

 

You agree to indemnify, defend, and hold harmless Battle Tested Specimen Collections, its owners, agents, and representatives from and against any claims, damages, losses, or expenses including reasonable attorney fees arising out of or related to:

— Your use of our website or services
— Your violation of these Terms
— Your violation of any applicable law or regulation
— Any employment or legal decisions made based on drug test results
— Inaccurate or incomplete information you provided to us

 

 

15. Privacy

 

Your use of our website and services is also governed by our Privacy Policy available at www.battletestedwa.com/privacy-policy. By using our services you consent to the collection and use of your information as described in our Privacy Policy.

 

 

16. Governing Law

 

These Terms shall be governed by and construed in accordance with the laws of the State of Washington without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in King County, Washington. You agree to submit to the personal jurisdiction of the courts located in King County, Washington for the resolution of any disputes.

 

 

17. Changes to These Terms

 

We reserve the right to update or modify these Terms at any time. We will notify you of significant changes by posting the updated Terms on our website with a revised effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.

 

 

18. Severability

 

If any provision of these Terms is found to be unenforceable or invalid that provision will be limited or eliminated to the minimum extent necessary so that the remaining Terms will otherwise remain in full force and effect.

 

 

19. Entire Agreement

 

These Terms together with our Privacy Policy, Accessibility Statement, and any signed Service Agreement constitute the entire agreement between you and Battle Tested Specimen Collections regarding your use of our website and services.
